Motion by appellant for poor person relief and assignment of counsel on an appeal from an order of the Criminal Court of the City of New York, Kings County, entered February 4, 2010.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED that the motion by appellant for poor person relief and assignment of counsel is denied.

No appeal as of right lies from an order denying a motion made pursuant to CPL 440.10 to vacate a judgment (see CPL 450.10).
