Renewed motion by the appellant to recall and vacate stated portions of a decision and order on motion of this court dated January 5, 2009, as amended October 20, 2009, which, inter alia, dismissed an appeal from an order of the Family Court, Westchester County, dated April 8, 2008, to reinstate the appeal, to return custody of the subject child to her, and for the assignment of counsel.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied.
