DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the County Court, Dutchess County, rendered March 26, 2009, for leave to prosecute the appeal under an anonymous caption and to enlarge the judgment roll to include certain documents.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to prosecute the appeal under an anonymous caption is granted, and the caption is amended as set forth above; and it is further,

ORDERED that the branch of the motion which is to enlarge the judgment roll to include certain documents is denied.
