| DECISION & ORDER ON MOTION |
Separate motions by the appellant on an appeal from a judgment of the Supreme Court, Queens County, rendered January 17, 2008, for leave to serve and file a supplemental brief raising the issues that his conviction of robbery in the first degree should be vacated and the count of the indictment charging that offense should be dismissed, and that the appellant's adjudication as a persistent felony offender violated the Federal constitution.
Upon the papers filed in support of the motions and the papers filed in relation thereto, it is
ORDERED that the motions are granted; and it is further,
ORDERED that the appellant's supplemental brief shall be served and filed on or before June 11, 2010; and it is further,
ORDERED that the respondent's brief, if any, in response to the appellant's supplemental brief shall be served and filed on or before July 12, 2010; and it is further,
ORDERED that the appellant's supplemental reply brief, if any, shall be served and filed on or before July 22, 2010.
