It is Ordered that the motion is granted to the extent of vacating this Court's March 25, 2010 order, previously granted on default, and substituting the following: The petitioners' motion is granted to the extent of directing the Commissioner of Finance of the City of New York to release the sum of nine thousand dollars ($ 9,000.oo) to the petitioners - Albert and Perla Aflalo. This sum represents the payment for six months of use and occupancy, at the rate of fifteen hundred dollars ($1,500.oo) per month, that this Court required the appellant to pay to the petitioners pending the appeal. The remaining balance on deposit, plus interest and less any costs, may be released to the appellant herein- James Post.
