DECISION & ORDER ON MOTION

Joseph Famigletti and Karen Rappaport, Respondents, v John Torres, Appellant.

Motion by appellant to continue a stay granted by order of this court dated January 6, 2010 and for an enlargement of time to perfect the appeal on an appeal from a decision of the Civil Court of the City of New York, Kings County, dated July 8, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED that the branch of the motion by appellant seeking to continue the stay contained in the order of this court dated January 6, 2010 is granted; and it is further,

ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is denied as moot.

Appellant has perfected the appeal.
