DECISION & ORDER ON MOTION

Motion by nonparty Lee M. Nigen, Esq. for leave to appeal from so much of an order of the Civil Court of the City of New York, Kings County, entered February 26, 2010, as imposed sanctions on him and, in the event leave is granted, for a stay pending the determination of the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,
ORDERED that the branch of the motion seeking leave to appeal from so much of the order dated February 25, 2010 as imposed sanctions on nonparty Lee M. Nigen, Esq. is granted; and it is further,
ORDERED that the branch of the motion seeking, in essence, to stay enforcement of the order dated February 26, 2010 is granted on condition that the appeal be perfected by August 6, 2010.
In the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondents may move to vacate the stay on three days' notice.
