Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Jefferson County Court, rendered October 6, 2006,
Now, upon reading and filing the affidavit of Clifford K. Pickett, sworn to April 7, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be and the same hereby is granted, and the ordering paragraph of the order entered December 28, 2009 is hereby amended by striking therefrom the date April 9, 2010, and inserting in place thereof the date September 21, 2010, on the condition that defendant file and serve a motion for poor person relief and assignment of counsel on or before July 1, 2010.
