DECISION & ORDER ON MOTION

Motion by Andree Sylvestre-Johnson, Esq., the attorney for the respondents-appellants for leave to withdraw as counsel on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated August 7, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, and Andree Sylvestre-Johnson, Esq., is relieved from representing the respondents-appellants with respect to the instant appeal; and it is further,

ORDERED that on or before June 10, 2010, Andree Sylvestre-Johnson, Esq., is directed to serve the respondents-appellants by one of the methods specified in CPLR 2103(c), with a copy of this order and shall file proof of such service with the Clerk of this court; and it is further,

ORDERED that no further proceedings shall be taken against the respondents-appellants, without leave of the court, until the expiration of 30 days after service upon them of a copy of this order; and it is further,

ORDERED that the respondents-appellants' time to serve and file an answering brief, including points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]), is extended until July 26, 2010; and it is further,

ORDERED that no further enlargement of time shall be granted.
