| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the time to serve and file a reply brief on appeals from two orders of the Supreme Court, Dutchess County, dated July 29, 2008, and November 17, 2008, respectively, and to enlarge the record to include certain documents and for leave to attach those documents to the reply brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the time to serve and file the reply brief is granted; and it is further,
ORDERED that the branch of the motion which is to enlarge the record to include certain documents and for leave to attach those documents to the reply brief is denied; and it is further,
ORDERED that the Clerk of the court or his designee shall remove the attachments from the copies of the reply briefs submitted to the Clerk of the court, and the references to those documents in the reply brief shall not be considered in determining the appeal; and it is further,
ORDERED that the Clerk of the court or his designee shall serve two copies of the reply briefs submitted to the Clerk of the court, with the attachments removed, on the Attorney General, and the reply briefs submitted to the Clerk of the court, with the attachments removed, are accepted for filing.
