Motion by appellant to vacate an order of this court dated July 17, 2008, which dismissed an appeal from an order of the Civil Court of the City of New York, Kings County, entered October 9, 2007.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,
ORDERED that the motion by appellant to vacate the dismissal of the appeal is denied.
Appellant fails to make a showing of merit to the appeal and fails to adequately explain its failure to timely perfect the appeal or to move promptly to vacate the dismissal.
