Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Oswego County Court, rendered September 30, 2004,
Now, upon reading and filing the affidavit of Rebecca A. Crance, Esq., sworn to April 19, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be and the same hereby is granted to the extent that the ordering paragraph of the order of this Court entered February 16, 2010, is hereby amended by striking therefrom the date April 19, 2010 and inserting in place thereof the date August 25, 2010, and,
It is further ORDERED that to the extent that any order pursuant to which the appeal was dismissed for failure to timely perfect is vacated nunc pro tunc.
