Motion by the plaintiff for leave to reargue his prior motion for leave to appeal to this court from an order of the Appellate Term, Ninth and Tenth Judicial Districts, dated December 1, 2009, which dismissed an appeal from an order of the City Court, City of Yonkers, Westchester County, entered August 15, 2008, which was determined by decision and order on motion dated March 30, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
