Application by the appellant on an appeal from an order of the Supreme Court, Nassau County, dated April 1, 2008, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a supplemental brief in accordance with a decision and order on motion of this court dated December 17, 2009.
ORDERED that the application is granted and the appellant's time to serve and file a supplemental brief is enlarged until September 17, 2010, and the appellant's supplemental brief must be served and filed on or before that date; and it is further,
ORDERED that no further enlargement of time shall be granted.
