ORDERED that the decision and order on motion of this court dated June 1, 2010, in the above-entitled appeal is recalled and vacated and the following decision and order on motion is substituted therefor:
Appeal by Creative Lighting Fixture Co. Inc., Estate of Bert Friedman, and Marc Friedman, from a decision of the Surrogate's Court, Nassau County, dated August 18, 2009.
On the court's own motion, it is
ORDERED that the notice of appeal from the decision dated August 18, 2009, is deemed to be a notice of appeal from an order of the same court dated September 11, 2009 (see CPLR 5512).
