| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to modify a preliminary injunction contained in an order of the Supreme Court, Suffolk County, dated April 30, 2010, to condition the preliminary injunction upon the payment of past due and future rent and to fix an undertaking, pending hearing and determination of an appeal from the order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied without prejudice to seeking relief in the Supreme Court, Suffolk County.
