Appellant having moved for an extension of time to perfect the appeals taken herein from orders of the Monroe County Surrogate's Court entered in the Office of the Clerk of said Court on January 7, 2009 and February 26, 2009, and an award of attorney's fees and costs pursuant to 22 NYCRR §§ 130-1.1 (c); 1000.16,
Now, upon reading and filing the affirmation of Michael Steinberg, Esq. dated March 25, 2010, the notice of motion with proof of service thereof, the affirmation of Michael A. Rosenhouse, Esq. dated April 9, 2010, the affidavit of Anthony Daniele sworn to April 6, 2010, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect is granted to the extent that the ordering paragraph of the order of this Court entered February 1, 2010 is hereby amended by deleting the date April 2, 2010 and inserting in its place the date August 2, 2010, and
It is further ORDERED that the motion is otherwise denied.
Memorandum: No further extensions of time to perfect will be granted.
