Respondent having moved to dismiss the appeals taken from a judgment of the Herkimer County Court, rendered July 25, 2007 and February 20, 2008, on the ground that appellant has failed to perfect timely the appeals, and appellant having cross-moved for an extension of time to perfect the appeals,

Now, upon reading and filing the affirmation of Prescott E. Klosner, Esq. dated May 3, 2010, the notice of motion with proof of service thereof, the affirmation of Richard N. Bach, Esq., dated May 17, 2009, the notice of cross motion with proof of service there of, and due deliberation having been had thereon, and,

It is hereby ORDERED that the motion be and the same hereby is granted to the extent that the appeals taken from the judgment rendered July 25, 2007 and February 20, 2008 are dismissed without further order unless the appeals are perfected on or before September 7, 2010, and,

It is further ORDERED that the cross motion is dismissed as unnecessary.
