Motion by Stuart I. Greenberg, Esq., counsel for the appellant, to be relieved and for the assignment of counsel to prosecute an appeal from an order of the Family Court, Orange County, dated March 12, 2010.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the court's own motion, the appeal taken as of right is dismissed, without costs or disbursements, as no appeal lies as of right from a nondispositional order of the Family Court in a proceeding pursuant to Family Court Act article three (see Family Ct Act § 1112[a]) and we decline to grant leave to appeal; and it is further,
ORDERED that the motion is denied as academic.
