It is Ordered that the motion to reargue is granted. Upon reargument, the April 27, 2010 dismissal order is hereby vacated and the re-instated appeal is to be perfected by no later than the October 2010 term - the filing deadline is August 9, 2010. In the event of appellant's failure to comply with the foregoing condition, the landlord-respondent may move on five days notice for an order dismissing the appeal.
