DECISION & ORDER ON MOTION

Motion by Ronald A. Markowitz to enlarge the time to perfect an appeal and cross appeal from an order of the Supreme Court, Westchester County, dated May 22, 2009.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that Ronald A. Markowitz's time to perfect the appeal is enlarged until July 29, 2010, and the joint record or appendix on appeal (see 22 NYCRR 670.8[c][1]) and Ronald A. Markowitz's brief must be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of time shall be granted; and it is further,

ORDERED that Richard A. Danzig's time to serve and file his answering brief, including his points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]), if Ronald A. Markowitz perfects his appeal, or to serve and file a record or appendix on the appeal and a brief, if Ronald A. Markowitz does not perfect his appeal is extended until September 13, 2010; and it is further,

ORDERED that no further enlargement of time shall be granted.
