DECISION & ORDER ON MOTION

Motion by the appellant for leave to appeal to the Court of Appeals from a decision and order dated February 23, 2010, which determined the appellant's application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this court dated November 14, 1988 (People v Singleton, 144 AD2d 504), affirming a judgment of the Supreme Court, Queens County, rendered March 11, 1985.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion is denied.
