| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, to hold in abeyance an appeal from an order of the Family Court, Richmond County, dated November 27, 2009, pending determination by the Court of Appeals of an appeal in a matter entitled Matter of Dylan C., pending under Docket No. 2010-00394, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is, in effect, to hold the appeal in abeyance is granted and the appeal is held in abeyance pending determination by the Court of Appeals of the appeal in the matter entitled Matter of Dylan C., pending under Docket No. 2010-00394; the parties shall advise this court expeditiously when the Court of Appeals determines the appeal in the matter entitled Matter of Dylan C., pending under Docket No. 2010-00394; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal in the matter is held in abeyance in the interim.
