Jones St. Bldg. v Moskowitz, Roselee

It is Ordered that the respondent-appellant's motion is granted only to the extent of staying the re-letting of the premises through June 30, 2010. This is to afford the appellant an opportunity to perfect the appeal on the original record of the trial court and to tender the arrears outstanding, along with marshal fees and legal fees, to the petitioner-landlord, without prejudice. If the two conditions are complied with, the appellant may move for a continuation of the stay of the re-letting of the premises pending the determination of the appeal.
