| DECISION & ORDER ON MOTION |
Appeal by Graeme A. Chambers from a judgment of the Supreme Court, Nassau County, entered February 17, 2010. By decision and order on motion dated April 19, 2010, the appellant's motion, inter alia, to stay enforcement of stated portions of the judgment pending hearing and determination of the appeal was granted to the extent that enforcement of so much of the judgment as directed the distribution of the remaining proceeds from the sale of the marital premises was stayed pending hearing and determination of the appeal, and the remaining proceeds were directed to remain in escrow with the respondent's attorney until the appeal was determined, on condition that the appeal is perfected on or before May 19, 2010. The appeal has not been perfected.
Now, on the court's own motion, it is
ORDERED that the stay of enforcement of so much of the judgment as directed the distribution of the remaining proceeds from the sale of the marital premises and the directive that the remaining proceeds remain in escrow with the respondent's attorney are vacated.
