| DECISION & ORDER ON MOTION |
Motion by the respondent-appellant to enlarge the time to serve and file an answering brief on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated January 8, 2009, and to remove the appeal and cross appeal from the calendar of June 21, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the respondent-appellant's time to serve and file her answering brief, including her points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]), is enlarged until July 1, 2010, and the respondent-appellant's brief shall be served and filed on or before that date; and it is further,
ORDERED that the appeal and cross appeal is removed from the calendar of June 21, 2010, and the appeal and cross appeal will be calendared after all of the briefs have been filed.
