Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated October 27, 2009.
ORDERED that the application is denied as premature as the time to perfect the appeal does not expire until August 17, 2010 (see 22 NYCRR 670.8[e][1]).
