| DECISION & ORDER ON MOTION |
Motion by the appellant to hold in abeyance an appeal from a judgment of the County Court, Nassau County, rendered January 13, 2009, pending determination of his motion pursuant to CPL 440 by the County Court, Nassau County.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the appellant's time to perfect the appeal is enlarged; retained counsel shall prosecute the appeal expeditiously in accordance with this court's rules (see 22 NYCRR 670.1, et seq.) and written directions.
