Motion by appellant for a stay pending the hearing and determination of an appeal from an order of the Civil Court of the City of New York, Queens County, entered April 22, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,
ORDERED that the motion by appellant for a stay pending the hearing and determination of the appeal is denied.
It appears that appellant's laches claim has not been presented to the Civil Court and is thus dehors the record on appeal.
