DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Raymond J. Gilliar and Rebecca R. Gilliar, Appellants.

Motions by appellants for summary reversal and for leave to file late reply papers on an appeal from a judgment of conviction of the Justice Court of the Village of Great Neck, Nassau County, rendered April 18, 2008.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is,

ORDERED, on the court's own motion, that the motions by appellants are consolidated for purposes of disposition; and it is further,

ORDERED that appellants' motion to file a late reply is granted and the reply is deemed timely served and filed; and it is further,

ORDERED that appellants' motion for summary reversal is denied; and it is further,

ORDERED, on the court's own motion, that an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by September 3, 2010; and it is further,

ORDERED, on the court's own motion, that the stay of sentence is continued on the condition that the appeal be perfected by September 3, 2010; and it is further,

ORDERED in the event that the above condition is not met, the court, on its own motion, may vacate the stay and dismiss the appeal, or respondent may move to vacate the stay and dismiss the appeal on three days' notice.
