Court's own motion to vacate an order of this court dated May 11, 2010 dismissing an appeal from an order of the District Court of Suffolk County, Second District, entered October 19, 2009.
ORDERED, on the court's own motion, that the order dated May 11, 2010 dismissing the appeal is vacated and the appeal shall be perfected by July 21, 2010. Respondent shall serve and file its brief by August 11, 2010 and appellant, if so advised, shall file a reply brief by August 18, 2010.
