Motion by the respondent for leave to reargue appeals from an order of the Supreme Court, Orange County, dated January 8, 2009, and a judgment of the same court entered February 5, 2009, which were determined by decision and order of this court dated March 30, 2010, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court.
