| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by the respondent for reinstatement to the Bar as an attorney and counselor-at-law. The respondent was admitted to the New York State Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 25, 1969, under the name Robert Michael Fuster. By order of the Supreme Judicial Court of the State of Massachusetts, entered February 13, 2008, the respondent was suspended for a period of 18 months, effective April 14, 2008. By opinion and order of this court dated October 7, 2008, the respondent was reciprocally suspended from the practice of law in New York for a period of 18 months based on his suspension in the State of Massachusetts.
Upon the papers submitted in support of the motion and the papers submitted in relation thereto, it is
ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on the respondent's fitness to be an attorney.
