DECISION & ORDER ON MOTION

Motion by the appellant Law Offices of Silverman & Taylor for leave to file a supplemental brief on an appeal from a judgment of the County Court, Nassau County, rendered July 31, 2006, which was determined by decision and order of this court dated October 7, 2008 (see People v Taylor, 55 AD3d 640), and remitted to this court by the Court of Appeals by order dated February 6, 2010 (see People v Taylor, 14 NY3d 727), and for oral argument regarding the issues raised on the remittur to this court.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted to the extent that on or before July 30, 2010, the appellant Law Offices of Silverman & Taylor shall serve and file a supplemental brief concerning the issue of whether its conviction of four counts of offering a false instrument for filing in the first degree was supported by legally sufficient evidence and supported by the weight of the evidence, in light of the determination by the Court of Appeals in People v Taylor (14 NY3d 727), and the motion is otherwise denied; and it is further,

ORDERED that the respondent shall serve and file a supplemental brief, if any, on or before September 7, 2010; and it is further,

ORDERED that the appellant Law Offices of Silverman & Taylor shall serve and file a supplemental reply brief, if any, on or before September 22, 2010.
