DECISION & ORDER ON MOTION

Motion by the appellant-respondent on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated September 23, 2009, in effect, to waive the motion filing fee, to strike the respondent-appellant's answering brief, and to impose a sanction upon counsel for the respondent-appellant.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is, in effect, to waive the motion filing fee is granted; and it is further,

ORDERED that the motion is otherwise denied.
