DECISION & ORDER ON MOTION

26 & 34 Butler, LLC., Respondent, v Georgette Innocent, Appellant, Yves Carmel Meirus, "John Doe" and/or "Jane Doe", Undertenants.

Motion by appellant to reinstate and continue a stay granted by order of this court dated August 13, 2009, and motion by landlord-respondent to file late opposition, on an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered March 19, 2009.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is,

ORDERED, on the court's own motion, that the motions are consolidated for purposes of disposition; and it is further,

ORDERED that respondent's motion to file late opposition is granted and the opposing papers are deemed timely served and filed; and it is further,

ORDERED that the motion by appellant to reinstate and continue the stay contained in the order of this court dated August 13, 2009 is denied.
