Petitioner having moved for an extension of time to file and serve a brief on the proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Seneca on February 9, 2010 and for other relief,
Now, upon reading and filing the affirmation of Patricia M. O'Rourke, Esq. dated May 4, 2010, the notice of motion with proof of service thereof, the affirmation of Marilyn Balcacer, Esq. dated May 20, 2010, the statement of Patricia M. O'Rourke, Esq. dated May 28, 2010, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to file and serve petitioner's brief is granted on the condition that the brief is filed and served on or before August 2, 2010 and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that respondents' briefs shall be filed and served on or before September 7, 2010, and
It is hereby ORDERED that the proceeding is removed from the September 15, 2010 day calendar of this Court and shall be added to the calendar for the term of this Court commencing October 18, 2010, and
It is further ORDERED that the motion is otherwise dismissed as moot.
