The People of the State of New York, Respondent, v Juan Guerrero, Appellant.

Motion by assigned counsel Steven Banks, Esq., Legal Aid Society, to dismiss as abandoned an appeal from a judgment of conviction of the Criminal Court of the City of New York, Queens County, rendered February 23, 2009.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is,

ORDERED that the motion by assigned counsel, Steven Banks, Esq., Legal Aid Society, to dismiss the appeal as abandoned is granted (see People v Dubrey, 217 AD2d [1995]; People v Cullum, 170 AD2d 524 [1991]; People v Velez, 156 AD2d 741 [1989]; People v Jinks, 140 AD2d 371, 372 [1988]).
