The People of the State of New York, Respondent, v Gershon Aizikowich, Appellant.

Motions by appellant to include the minutes of his arraignment in the record on appeal and to dispute statements made in the respondent's brief on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered December 10, 2008.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED, on the court's own motion, that the motions by appellant are consolidated for purposes of disposition; and it is further,
