It is Ordered that the motion is granted to the extent of permitting the appellant Lee Nigen to proceed with the appeal on the appendix method. The order of the Civil Court is stayed provided that the appeal is perfected by September 7, 2010 and noticed for no later than the November 2010 term. Otherwise the respondent may move on five days' notice for an order vacating the stay of the Civil Court order.
