It is Ordered that the third party defendant-appellant's motion to consolidate two appeals from the March 19, 2009 and January 20, 2010 orders from the Civil Court is granted. This order is without prejudice to defendant/third-party Marlite Construction raising, on appeal, the issue of whether the second order being appealed should be considered a motion to re-argue.
