Application by the appellant on appeals from two orders of the Supreme Court, Queens County, dated October 29, 2009, and January 4, 2010, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect the appeal from the order dated October 29, 2009.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the appeals are dismissed, without costs or disbursements, as the orders are not appealable as of right and leave to appeal has not been granted (see CPLR 5701), without prejudice to taking an appeal from the judgment entered June 16, 2010 (see Matter of Aho, 39 NY2d 241); and it is further,
ORDERED that the application is denied as academic.
