ORDER ON APPLICATION

Application by Building and Realty Institute of Westchester & Mid-Hudson Region (BRI) a/k/a Builders Institute, Inc., pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file an amicus curiae brief on an appeal from a judgment of the Supreme Court, Westchester County, entered May 8, 2009. Separate application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.

ORDERED that the applications are granted; and it is further,

ORDERED that the amicus curiae brief must be served on the parties, and nine copies filed in this court on or before July 16, 2010; and it is further,

ORDERED that no oral argument by the amicus curiae shall be permitted; and it is further,

ORDERED that the respondent's time to serve and file a brief is enlarged until July 16, 2010, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the parties, if they be so advised, may file reply briefs to the amicus curiae brief on or before August 5, 2010.

ORDERED that the appellants' time to serve and file a reply brief is enlarged until August 5, 2010, and the reply brief, if any, must be served and filed on or before that date.
