Motion by Bernard V. Kleinman, Esq., to relieve counsel assigned to prosecute an appeal from a judgment of the Supreme Court, Queens County, rendered November 9, 2009, and substitute him as retained counsel, and to continue the appellant's poor person status.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied with leave to renew upon proper papers including a statement from the appellant indicating that he approves of the substitution.
