DECISION & ORDER ON MOTION

Motion by the appellant's assigned counsel to be relieved as counsel on an appeal from a judgment of the County Court, Westchester County, rendered May 19, 2009, on the ground that the defendant does not intend to pursue the appeal. Cross motion by the respondent to dismiss the appeal for failure to timely perfect.

Upon the papers filed in support of the motion and the cross motion, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the cross motion is granted, and the appeal is dismissed; and it is further,

ORDERED that the motion is granted and assigned counsel is relieved.
