Now, upon reading and filing the affidavits of Paul D. Weiss, Esq. sworn to June 10, 2010 and June 30, 2010, the notice of motion with proof of service thereof, the affidavit of Denise M. Malican, Esq. sworn to June 28, 2010, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to dismiss the appeal is granted and the appeal is dismissed without further order unless the appeal is perfected on or before September 13, 2010.

It is further ORDERED that the motion is otherwise denied.
