Motion by appellant to vacate an order of this court dated April 13, 2010 dismissing an appeal from an order of the District Court of Nassau County, First District, entered August 17, 2009.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,
ORDERED that the order dated April 13, 2010 dismissing the appeal is vacated and the appeal shall be perfected by September 3, 2010. Respondent, if so advised, may serve and file his brief by September 17, 2010 and appellant, if so advised, may serve and file a reply brief by September 24, 2010.
