Motion by appellant to vacate an order of this court dated May 11, 2010 dismissing an appeal from a judgment of conviction of the Justice Court of the Village of Upper Nyack, Rockland County, rendered March 3, 2009.
Upon the papers filed in support of the motion and the papers filed in response thereto, it is,
ORDERED that the motion by appellant to vacate the dismissal of the appeal is granted and the appeal shall be perfected by October 1, 2010.
