Motion by appellant for poor person relief and assignment of counsel on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered December 4, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,

ORDERED that the motion by appellant for poor person relief and assignment of counsel is denied.

By order of this court dated April 23, 2009 the appeal was dismissed. Appellant fails to show good cause to vacate the dismissal of the appeal.
