State Farm Mutual Automobile Insurance Company as Subrogee of Aisha Campbell, Appellant, v Pedro Nunez Delacruz, Respondent and Joseph Guichard, Defendant.

Motion by respondent to stay the suspension of his driver's license and for leave to reargue or, in the alternative, to appeal to the Appellate Division from an order of this court dated January 29, 2010 which reversed an order of the Civil Court of the City of New York, Queens County, entered January 15, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED that the branch of the motion by respondent seeking to stay suspension of his driver's license is denied; and it is further,

ORDERED that the branch of the motion for leave to reargue or, in the alternative, to appeal to the Appellate Division is denied.
